Leaked letter from Trump’s lawyers offers glimpse of his legal strategy

Lawyers for President Donald Trump said in a letter to Special Counsel Robert Mueller that Trump wouldn’t comply with the special counsel’s requests for an interview, that Trump could end the investigation, and, if needed, could use his executive powers to pardon.

The January 2018 letter was obtained by The New York Times, along with a letter sent in June 2017, and provide the clearest view thus far of Trump’s legal strategy in Mueller’s investigation. Trump’s lawyers wrote that they strongly oppose the special counsel’s request to interview him, saying “under our system of government, the president is not readily available to be interviewed.”

The memo cites Trump’s lawyers arguing that he “could neither constitutionally nor legally constitute obstruction because that would amount to him obstructing himself, and that he could, if he wished, terminate the inquiry, or even exercise his power to pardon if he so desired.”

Trump implied in a Saturday morning tweet — a few hours before the letters were published — that Mueller and the Justice Department were the cause of his lawyer’s letters being leaked to the media.

“There was No Collusion with Russia (except by the Democrats). When will this very expensive Witch Hunt Hoax ever end? So bad for our Country,” Trump tweeted. “Is the Special Counsel/Justice Department leaking my lawyers letters to the Fake News Media? Should be looking at Dems corruption instead?”



“I think his strategy, which he’s not very subtle about, is rather than [fire Mueller] he will simply try to undermine the investigation and undermine Mueller,” former Intelligence Chief James Clapper said of Trump. “And so that regardless of what he comes out with, many in the public, particularly those who are in the Trump base, will not find it credible.”
